CORPORATIONS ACT 2001 – SECT 601RAD
Meaning of person with a proper interest(1) (c) in the case of the estate of a deceased person:
(i) if the person died testate–a beneficiary under the person’s will(d) in the case of any other trust:
(i) the settlor, or one of the settlors, of the trust; or
(ii) a person who, under the terms of the trust, has power to appoint or remove a trustee of the trust or to vary (or cause to be varied) any of the terms of the trust; or
(iii) a beneficiary of the trust;
It is also a Federal Act, so it can be used in every state in Australia

Can also be done by deed, no need to mention a term so to speak, “it is my will that…”.
Also in PPSA 2009, a priority holder/purchaser is mentioned in sections 70 and 72, I prefer section 72. That is the equivalent I believe. But I dont think it is essential to quote, see my post in a new Victorian topic.

in usA we send in a birth certificate ,Trust Transfer Grant Deeds ahead of time making them the receiver/trustee and we are the surety/subrogee/settlor … wear many hats
